Judge Charles Price entered a most important order on October 13th in the State of Alabama’s lawsuit against a number of drug companies. The veteran trial judge denied an attempt to have the case dismissed after hearing arguments from both sides. The denial of the defendant’s motions will allow the case to proceed. We have contended on behalf of the State, among other things, that the companies fraudulently inflated the price of drugs sold to the Medicaid program in Alabama over a number of years. As a result, the State has been overcharged to the tune of an amount estimated to be over $600 million. There are currently 79 defendants in the case. We believe that the State has a very strong case, and now that the court has entered its order allowing the case to proceed, we can start to get the case ready for trial.
